Labor certification cases are initially filed with the state office which has jurisdiction
over the case. Jurisdiction is determined by the location of the company OR the location
where the work will be performed. Once the state office completes processing of the case,
they forward it to the regional office of the U.S. Department of Labor which has jurisdiction
over the state office. The U.S. Department of Labor is the office which makes the final decision
on the case.
The U.S. Department of Labor website includes the processing times at the local state offices
as well as at the regional offices. The state office information indicates the receipt date of
cases that they are currently working on. In order to obtain information about your case, you
will need to know the type of case (Reduction in Recruitment, Regular Permanent, or H2-B) and
the date that it was filed in the state office.
The regional office information indicates the receipt date of cases that they are currently working
on. This "date" is the date that the case was received at the regional office, not the date that
the case was originally received at the state office. Therefore, in order to obtain information
about your case, you will need to know the type of case, and the date that it was sent to the
regional office. Unfortunately the U.S. Department of Labor website does not enable you to check
the status of your case by it's case number. You will be able to learn how far behind each office
is and based on this information, you should be able to make an educated guess about how long it
will take for the regional office to get to your case. The processing times on this website are
usually updated every month.
