H2B VISAS
H2B visas are available to workers who will be employed in the United States on a
temporary basis, generally for less than one year. In order to file an H2B visa on
behalf of potential workers, the U.S. employer must prove:
That the company has a temporary position available due to a seasonal
need, peak load need, intermittent need or one time occurrence the business operations
That the company can and will pay workers the "prevailing wage" for the
position, as determined by the Department of Labor
That there are no qualified U.S. workers who are willing and able to
take the position
Applicants for such visas must prove that they have the proper experience for the
position offered, that they are admissable to the United States and intend to return
to their home country upon expiration of their visas. The spouses and children of
H2B visa holders are eligible for H4 visas.
